LCI FEE-HELP Review procedures

 

Introduction

Leo Cussen Institute has a review procedure for reconsidering decisions relating to a student’s Commonwealth assistance [conforming with HESA 19-45(1)(c)]. This review procedure is published annually in the student handbook and updated regularly and is available on the LCI website. The review procedure complies with the provisions in the HESA concerning the review of decisions and with those of the Higher Education Provider Guidelines (s238.10 of the Higher Education Support Act 2003).

 

Applying for a FEE-HELP review

A student has the right to request a review of a number of decisions under the HESA, including a review of any decisions relating to re-crediting or remitting of Commonwealth

assistance [HESA s206-1].

 

A student seeking a review of a decision relating to the re-crediting of their FEE-HELP balance must make their request in writing within 28 days of receipt of the notice of the original decision, or such longer period as the reviewer allows. The request, in writing, must state the reasons for requesting a review and must be given or sent to LCI’s FEE-HELP Review Officer [in compliance with HESA 209-10] at Leo Cussen Institute, 360 Little Bourke Street, Melbourne  3000 or GPO Box 353 Melbourne 3001 or DX 460 Melbourne.

 

Reviewing a FEE-HELP decision

LCI must provide a written acknowledgement of receipt of a person's request for a

review. This notice must also inform the person that if the LCI review officer has not made a decision within 45 days of receiving the request, then the original decision is taken to be confirmed, and the person may appeal to the Administrative Appeals Tribunal (AAT). The notice must contain contact details of the nearest AAT and the approximate cost of lodging an appeal with the AAT.

 

When a LCI review officer has made a decision, s/he must inform the person, in writing, of the reasons for the decision. This notice must also inform the person of their right to appeal to the AAT, and provide the relevant contact details and approximate cost of lodging an appeal. [HESA - s209-5 (5 & 6)]

 

The LCI review officer may confirm the original decision, vary the decision or set the decision aside and substitute a new decision. [HESA - s209-5 (3)]. The Review Officer for 2008 is Elizabeth Loftus, Executive Director of the Institute.

 

 

Fairness & FEE-HELP

Leo Cussen Institute (LCI) takes seriously the issue of fairness to students and we comply with subdivision 19-D of the Higher Education Support Act 2003 (HESA) which sets out the fairness requirements for higher education providers. The basic fairness requirements are that a higher education provider must treat fairly:

 

all of its students; and

 

all persons seeking to enrol with the provider.

 

Under our FEE-HELP obligations, Leo Cussen Institute must ensure that the opportunities and benefits of FEE-HELP are made equally available to all students, or classes of students, that are eligible to be paid the assistance.

 

We have open, fair and transparent procedures that are based on merit for making decisions about the selection and treatment of students who are to benefit from Commonwealth assistance like FEE-HELP. When making such decisions, Leo Cussen Institute may take into account any educational disadvantage which a student may have experienced.
